Waiver of Liability and Release

I acknowledge that the activities and services provided by YinPlusYang (the "Company"), and all other persons acting in any capacity on behalf of the Company (collectively, the "Services"), include guided video practices featuring EFT (Emotional Freedom Techniques) tapping, guided meditation, mindset activations, somatic movement (including yoga-based exercises), journalling practices and other self-growth or wellness-based practices. These activities may be physically, emotionally, and psychologically engaging, and participation carries inherent risks.

1. Nature of the Services

I understand that the Services are pre-recorded or digitally delivered and are intended for general wellness and personal development purposes only. The Services do not constitute medical advice, psychotherapy, psychological treatment, or any form of clinical intervention. The Company and its practitioners are not licensed medical or mental health professionals acting in a clinical capacity.

2. General Assumption of Risk

In consideration of being permitted to access and participate in the Services, I acknowledge and agree that:

  • There is an inherent risk of physical, emotional, and psychological discomfort or distress when engaging in somatic movement, yoga-based exercise, EFT tapping, guided meditation, mindset work, and journalling practices;

  • My participation in the Services is entirely voluntary;

  • I voluntarily and fully assume all risks of physical injury, emotional discomfort, psychological distress, or illness (including aggravation of pre-existing conditions) that may result from my participation in the Services.

3. Waiver and Release of Liability

To the fullest extent permitted by applicable law, I, on behalf of myself, my heirs, personal representatives, and assigns, hereby waive, release, and discharge YinPlusYang, its owners, facilitators, contractors, collaborators, successors, and assigns (collectively, the "Released Parties") from any and all liability, claims, and causes of action of any nature arising from:

  • Physical injury, illness, or bodily harm;

  • Emotional distress, psychological discomfort, or the surfacing of difficult memories or emotions (which may occur particularly in EFT tapping, somatic, meditation, or journalling practices), or in extreme cases, serious injury or death;

  • Any adverse reaction or outcome resulting from my participation in the Services;

regardless of whether such outcomes result, in whole or in part, from the actions, omissions, or negligence of any Released Party.

4. Indemnification

I agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with my participation in the Services or any breach of the terms of this document.

5. Health and Medical Responsibility

I confirm that:

  • I have been advised to consult with a qualified medical or mental health professional before undertaking any physical, emotional, or wellness practice, including the Services;

  • I take full responsibility for assessing whether the Services are appropriate for my current physical and mental health condition;

  • I understand that certain practices within the Services — particularly EFT tapping and somatic movement — may bring up strong physical sensations or emotional responses, and I agree to proceed at my own pace and discontinue any practice that does not feel safe for me;

  • None of the Released Parties has represented that my participation in the Services is safe for me, or that it will produce any specific physical, psychological, or other outcome.

6. Not a Substitute for Professional Care

I acknowledge that the Services are not a replacement for professional medical, psychiatric, psychological, or therapeutic care. If I am currently experiencing a serious mental health condition, trauma, or physical illness, I agree to seek appropriate professional support before or alongside using the Services.

7. Non-Recording and Intellectual Property

I agree that I will not copy, photograph, screen-record, broadcast, retransmit, or otherwise reproduce in any manner any portion of the Services or any materials provided in connection with the Services. I acknowledge that all content within the Services is the intellectual property of YinPlusYang and is provided solely for my personal, non-commercial use.

8. Governing Law and Dispute Resolution

This agreement shall be governed by the laws of the jurisdiction in which YinPlusYang operates. Any disputes arising out of or in connection with this agreement shall be resolved through good-faith negotiation in the first instance, and thereafter through mediation or arbitration in accordance with applicable law. Nothing in this clause limits any statutory rights I may have under the laws of my country of residence.

9. Severability

If any provision of this Waiver is found to be unlawful, invalid, or unenforceable under applicable law, the remaining provisions shall continue in full force and effect.

10. Minors

If I am under the age of 18 (or the age of majority in my jurisdiction), I confirm that this Waiver has been reviewed and accepted by my parent or legal guardian on my behalf.

11. Acknowledgement

By signing up to YinPlusYang and engaging with the content and video library, I confirm that:

  • I have read and fully understood this Waiver;

  • I am signing voluntarily and with full knowledge of its contents;

  • I understand this is a legally binding document.
